Terms and Conditions for Qori Qilka Adventures Travel Agency

Welcome to Qoriqilka Travel Agency. By accessing our website or using our services, you agree to comply with and be bound by the following terms and conditions. Please read them carefully before making any bookings or inquiries.


1.Reservation Policies for Qori Qilka Adventures

Initial Deposit: To secure a reservation for a Tour and Trekking with Qori Qilka Adventures, clients must make a non-refundable deposit (The amount will vary depending on the itinerary booked by the client). This deposit can be paid using PayPal or Credit/Debit Card. Please note that the traveler will incur a 5% merchant fee, which applies to both payment methods. Once a reservation has been initiated, the client will be considered to have read and carefully accepted the Terms and Conditions of Qori Qilka Adventures.

Confirmation: You will receive a confirmation email for the tour for which you made a deposit. In that email, you will receive this document in PDF format. By booking with us, you agree to comply with the Terms and Conditions described in this document, and the contract becomes valid.

Information Required for Reservation: Along with the non-refundable deposit, we require the submission of specific personal details: full name, passport number, gender, nationality, and date of birth during the reservation process.

 


2. Deposit

When booking a tour with us, you agree to pay a non-refundable and non-transferable deposit for the selected tour. The deposit will be 50% of the total tour cost. This deposit secures your spot on the tour and covers initial operational costs. Please note that any subsequent cancellation or modification will not be refunded or transferred. We recommend ensuring your availability before finalizing the reservation.

 


3. Payment Policies 

3.1. Accepted Payment Methods: For initial deposits and final payments, we accept cash, credit or debit cards. No traveler may begin the tour unless payment is fully settled.

3.2. Balance or Final Payment: Balance payments must be made at least 2 days (48 hours) before your tour. Payments can be made in cash or by debit/credit card. Card payments incur a 5% service fee.

3.3. Cash Payments: Cash payments must be made at least 2 days before your tour. We accept U.S. dollars and Peruvian soles for cash payments. Please note: torn or damaged bills, regardless of the extent of damage, will not be accepted.

3.4. Bank Fees on Final Payment: All bank fees or transaction charges associated with payments will be the responsibility of the client.

4. Cancellation and Refund Policies

4.1. Initial Deposit: Unfortunately, all initial deposits are 100% non-refundable and non-transferable under any circumstances. Even in the case of a medical emergency, your deposit will remain non-refundable (we do not accept medical notes or documentation as proof for refunds). This is because we allocate these funds to secure your permits, tickets, and proceed with the reservation of your campsites, hotels, and trains, all of which are non-refundable for us. Please note that there are no exceptions to this policy.

4.2. Change of Dates: If you change the date:

  • One week before the tour, you will lose 80% of the total cost of your tour.
  • Two weeks before the tour, you will lose 70% of the total cost of your tour.
  • Three weeks before the tour, you will lose 50% of the total cost of your tour.
  • One month before the tour, you will lose 40% of the total cost of your tour.

 

Please note that this fee is not for us; rather, we need to purchase new tickets as we have already secured all tickets for your original date, which will be lost.

It’s important to note that tickets for Machu Picchu and others are non-refundable and non-transferable.

4.3. Cancellations:
Cancellation terms are defined by how much time in advance we are notified. Regardless of the reason, cancellations incur different penalties, which you, as our customer, agree to comply with:

  • Cancellations made one week before the trek are subject to losing 100% of the total cost of your tour.
  • Cancellations made two weeks before the trek are subject to losing 80% of the total cost of your tour.
  • Cancellations made three weeks before the trek are subject to losing 70% of the total cost of your tour.
  • Cancellations made one month before the trek are subject to losing 60% of the total cost of your tour.

 


5. Medical Information and Responsibilities

5.1. Mandatory Disclosure:
When booking, travelers must inform Qori Qilka Adventures about any existing medical conditions, allergies, or specific health concerns.

5.2. Health and Fitness:
Participants must be in optimal physical condition. If you have any doubts about your health, consult with your doctor. If you are over 70 years old, a current medical certificate confirming your good health will be required.

5.3. Tour Suitability Assessment:
You are responsible for determining whether a tour is appropriate for you, considering your medical history, current condition, and physical abilities. Consult your doctor for medical guidance, vaccination recommendations, and other preventive measures. Qori Qilka Adventures does not provide medical consultations or advice.

5.4. Participation Rights:
Qori Qilka Adventures reserves the right to deny any individual the right to travel or participate in specific tour activities if their physical or mental condition is deemed unsuitable for the trip or poses a risk to themselves or others.

5.5. Pregnancy Disclosure:
Pregnancy is classified as a medical condition and must be disclosed at the time of booking. Qori Qilka Adventures may refuse to accept pregnant women or individuals with specific medical conditions if accommodations or appropriate alternatives cannot be guaranteed.

5.6. Travel Insurance:
We strongly recommend all travelers to obtain comprehensive travel insurance. This can offer protection for medical emergencies, tour cancellations, or other unexpected events during the trip.

 


6. Assumption of Risks

This trip and exploration carry associated risks. These risks may be caused by, but are not limited to, natural forces, animals, insects, and vegetation. By proceeding with your reservation, you acknowledge these potential risks. Your decision to join any of our tours indicates your voluntary acceptance and understanding of these risks.


7. Passports and Visas

Travelers must ensure their passports are valid for a minimum of 6 months after their travel dates and have the necessary visas. Qori Qilka Adventures is not responsible for any passport or visa issues. If you are renewing your passport, please contact us as soon as possible and send us photos of both the old and new passports. Failure to update may result in denial of entry to Machu Picchu and other sites if you have booked in advance.


8. Limitation of Liability

Qori Qilka’s financial liability to its clients is strictly limited to the total amount they have paid to the company. Beyond this monetary limit, Qori Qilka will not be responsible for any direct or indirect damages, losses, or costs incurred by the client unless explicitly specified in these Terms and Conditions.


9. Applicable Law

All interactions, transactions, and potential disputes arising from the use of this website or any engagement with Qori Qilka Adventures will be subject to the legal jurisdiction of Peru. By using our services, you, the client, consent to the jurisdiction and governance of Peruvian courts for any issues or disputes that may arise.


10. Right to Use Images

By participating in any activities offered by Qori Qilka Adventures, the client expressly grants permission to Qori Qilka Adventures to capture and use any images, photos, and videos taken during the tour for promotional, advertising, and any other marketing purposes. This includes, but is not limited to, use in brochures, online marketing, and social media platforms.

The client acknowledges that they will not receive any financial or other compensation for the use of such images, photos, or videos. This consent is given freely and without expectation of any return or benefit.

However, if the client does not wish for Qori Qilka Adventures to use their images for promotional purposes, they must notify their Experience Designer via email before the trip.
